The plaintiff, having established default and compliance with the Money Lenders Ordinance, is entitled to a money judgment and possession; as a legal chargee of a partial interest the plaintiff has locus under Partition Ordinance s3(1) and, applying the established discretionary principles, an order for sale of the whole property is appropriate because partition is impracticable and sale would be fair; contractual indemnity costs are awarded and summarily assessed at HK$132,047.
