The plaintiff failed to prove the alleged 2nd oral agreement and its asserted terms; the pleaded 1st agreement was not established; evidence established only a loose understanding and ultimately an equal division of the goods and that the defendant, holding the plaintiff's share, rendered an account and tendered sums; accordingly no contractual liability to account as alleged was proved and the plaintiff's claim is dismissed.
