The Tribunal held that it may assess reasonable professional fees itself using ordinary principles of loss assessment rather than being limited to taxation practice; the applicant proved the fees were reasonably incurred, the hourly rate charged was reasonable, the hours claimed represented actual work and were not shown to be unreasonable or unmitigated, and therefore the Government's proposed deductions were refused; costs awarded to the applicant on the High Court Scale to be taxed if not agreed.
