The appeal was dismissed because the master's exercise of discretion to grant retrospective leave for the plaintiff to file and serve the supporting affidavit was lawful and appropriate: the delay was a short irregularity, the affidavit disclosed arguable grounds on the merits and there was no evidence of repeated breaches or want of good faith to justify penal conditions. Accordingly the originating summons was not struck out and the Land Registry registration was not vacated; an order for payment into court was not justified in the circumstances.
