On proper construction the testing and commissioning clause required site completion at Guilin or, failing completion within eight weeks after arrival at site, entitled the seller to the 10% balance; the defendant took delivery without reservation on 13 March 1987 thereby unconditionally accepting the goods and fixing liability to pay the cheque; no triable issue existed to justify the unconditional leave to defend granted by the Master, so that order was set aside and plaintiff granted leave to sign judgment.
