Where the prescribed conditions for forfeiture under the Import and Export Ordinance were established and the claimant failed to discharge the onus of proving a good reason to the contrary on the balance of probabilities, the magistrate erred in ordering return of the goods and the correct order is forfeiture to the Crown; magistrates should give reasons for such decisions.
