By majority the Court concluded there was no proper ground to interfere with the Medical Council's sanction in this case and upheld the Council's order of removal from the General Register for nine months; the Court reaffirmed that while the appellate court may review and substitute penalties applying the principles in Ghosh/Preiss, deference to a professional tribunal's judgment on sanctions remains appropriate where the tribunal's decision falls within a reasonable range.
