The order nisi made on 25 April 2017 became absolute 14 days after pronouncement (9 May 2017) under O42 r5B(6) because no application to vary was made within that period and no extension was sought under O3 r5; consequently the court had no basis to vary the order and, alternatively, even if jurisdiction existed the court refused to order indemnity costs against Elite because the substantive culpability lay with Stephen who had been discontinued.
