Clause 3 of the 1981 will creates a disposition that, under the pre-2013 perpetuity law applicable to a will taking effect in 1984, may vest outside the permissible perpetuity period and is therefore void for remoteness; consequently the 1st Floor falls into the residuary legacy under clause 4 and vests in the residuary legatees as tenants-in-common in equal shares, but the court will not grant unconditional authority to the administrator to sell the property without appropriate arrangements among the residuary legatees or appointment of the administrator of the deceased residuary legatee.
