The court held the nine emails remain subject to the implied undertaking because the plaintiff used information derived from the originally disclosed eleven emails to frame a later PDPO access request and thereby circumvent the undertaking; the proposed amendments failed to plead required particulars of publication and were barred by the earlier consent order and constituted an abuse of process; accordingly the appeal was dismissed and costs awarded to defendants on an indemnity basis.
