The Court held that although the original orders for service outside the jurisdiction should be discharged for material non-disclosure, that breach did not create an absolute bar to a renewed application; given the substance of the claims, the location of assets in Hong Kong and the plaintiff's undertaking regarding Taiwanese proceedings, leave to serve Mr Hu out of the jurisdiction should be granted and the orders dismissing the actions against Mr and Mrs Hu set aside; service on Mrs Hu was valid under Hong Kong law.
