Court found only one proven breach: 1st Defendant took photographs of Plaintiff's samples and sent them to his personal Gmail without authorization, breaching his duty of fidelity. Plaintiff failed to prove ACS was a competing business during employment, failed to prove diversion of a maturing business opportunity or passing off, and failed to prove loss causally connected to the breach; Labour Department settlement did not bar common law claims. Consequently only nominal damages awarded ($100) and claims against 2nd and 3rd dismissed; counterclaim dismissed.
