Respondent failed to prove a common intention constructive trust on the balance of probabilities: evidence filed late and unpleaded was thin, circumstantial material (relationship, photographs, bills, crossed-out name on S&P, bank withdrawal) did not establish agreement or correlate to the purchase, household payments were equivocal, and therefore Respondent was at best a licensee whose licence terminated on the owner’s death; original order for vacant possession was therefore correct and the review is dismissed.
