Leave to appeal refused because the court was not satisfied there was a reasonable prospect of success on the core challenges: the judge did not err in applying the serious‑issue threshold to standing and damage; no basis to disturb findings on non‑disclosure; the arrest provision was within the court's discretion, circumscribed, did not confer police powers and paragraph 5 was to be read as requiring lawful process and observance of ss 51–52 Police Force Ordinance so as not to mandate unlawful detention.
