The conviction was unsafe because the complainant had only fleeting, disadvantaged opportunities to observe the thief, failed to identify the accused prior to the parade, and the parade was impermissibly suggestive (the accused was the only person previously seen), creating a real danger of mistaken identification; accordingly the conviction was quashed and appeal allowed.
