Leave to appeal out of time was refused because the appeal had no realistic prospect of success: the respondent's refusal of the dependent visa extension was not irrational, the applicant had been divorced and sponsorship withdrawn, and the old policy of unconditional stay after three years was no longer in force.

Section 13A(1) confers a discretionary power not a duty; detention under section 13D(1) was lawful following the change in policy; the applicants failed to establish a legitimate expectation that the prior policy would continue to apply to them and, in any event, the government lawfully implemented an immediate policy change which could defeat such expectations; accordingly leave to apply for judicial review was refused.
