Because the plaintiff's pleadings and affidavits contained significant unexplained inconsistencies as to who received the stones and the nature of the agreement, the judge below failed to determine whether there was a good arguable case required by Order 11 r4(2); on fresh consideration the Court of Appeal found no good arguable case and quashed the order for service out of the jurisdiction.
