Given the plaintiffs' uninterrupted possession since 1905, absence of any enforcement or possession by the mortgagee, and absence of any acknowledgment of liability, the mortgage had become incapable of subsistence or otherwise unenforceable by operation of section 19 of the Limitation Ordinance; therefore the court must grant a declaration to that effect.
