The appeal was dismissed because the appellate court concluded the magistrate was entitled to disbelieve the repairman defence and reasonably inferred from the presence of an infringing CD in the tray, the Adaptee Toast software running, the appellant's position and conduct and his experience with computers that the appellant was in possession of articles with knowledge or reasonable belief as to their use for making infringing copies, satisfying the elements of the offence under the Copyright Ordinance.
