The convictions were upheld because the defence effectively conceded the presence of the drugs in the desk drawer, allowing the jury to distinguish that issue from the acquittal on the count concerning drugs allegedly found on the applicant's person; the trial judge correctly directed the jury on burden, standard of proof and credibility, and the alleged evidential deficiencies were matters for the jury to weigh, not errors of law warranting leave to appeal; accordingly the application for leave to appeal was refused.
