The trial judge materially misdirected the jury by conflating the statutory presumption of possession with the separate presumption as to knowledge under s.47, leaving the jury in possible confusion on the decisive issue of knowledge; as a result the verdict was unsafe, the conviction was quashed and a new trial ordered.
