The Court held that, in the circumstances of this case, the prosecution was not required to establish that the Chief Executive or the ICAC Commissioner had a formal legal power to terminate or interfere with the investigation; given their constitutional and institutional positions they were plainly in a position to influence or affect the investigation such that the appellant's threats and requests had a tendency to pervert the course of justice; accordingly Question 1 is answered in the negative and the appellant's conviction and sentence are upheld.
