The Court of Appeal allowed the appeal: the deputy judge's wide declaratory judgment was unsupportable because after findings below there was no justiciable lis and the declaration operated as an advisory opinion affecting third parties; accordingly the declaration must be set aside and the appellate court should not decide the contested statutory interpretation issue of s.15 in the absence of a proper concrete dispute.
