The court declared that on allotment the Plaintiff was the beneficial owner of the 2,000 shares and that Mr Seidel held those registered shares as bare trustee for the Plaintiff, and ordered the register of members of the 1st Defendant company to be rectified by striking out Mr Seidel's name and inserting the Plaintiff's name because no personal representative of the deceased was available in Hong Kong to effect a transfer.
