On construction of the will as a whole the testatrix intended the Foundation to hold the estate on charitable trusts for the objects set out in Clause 2 with binding obligations and discretionary distribution powers under Clause 4; therefore the Foundation is not the absolute beneficial owner and the appeal is dismissed.
