The Tribunal's penalty of fines was 'clearly wrong' given the systemic, pervasive and serious accounting breaches and lack of adequate supervision; suspension better protects the public and maintains confidence. The Court substituted fines with suspensions (R1 four years, R2 two years) with effect from 14 November 2023, upheld the Tribunal's Conditions, censure and costs, and held that prior practising conditions imposed by the Law Society are a separate statutory exercise that do not aggregate with the Tribunal's statutory limit under s10(2)(ba) LPO.
