Although the Defendants omitted material particulars about vehicular access at the ex parte hearing, the omissions were not shown to be deliberate, the Defendants established serious issues to be tried on both Special Condition 30(a) and prescriptive user (including possible vehicular use), and the balance of convenience favoured continuation because irreparable harm to the Defendants' business could not be adequately compensated by damages; therefore the interlocutory injunction was continued rather than discharged.
