The convictions were quashed because the prosecution did not adduce sufficient evidence to prove that the appellants went beyond mere presence and actively participated with control or a managerial role in operating the gambling business; absent proof of an active part or control the offences under s.5(c) could not be sustained and the court could not substitute an uncharged alternative verdict without proper amendment.
