Given the company’s chaotic affairs, the imminent risk of delisting, the ongoing and advanced restructuring which could preserve the listing asset, and the minimal/confined risk of conflict from Deloitte’s prior engagement balanced against the company’s, shareholders’ and creditors’ interests, it was proper to appoint provisional liquidators with specified restructuring powers to preserve assets and enable the restructuring to proceed.
