The court found the plaintiffs had engaged in inordinate and inexcusable delay; that the delay caused relevant prejudice to the defendant by eradicating the insurer's subrogation remedy (the carrier actions having been struck out) and that the six year limitation period had expired so fresh proceedings were barred; accordingly, in exercise of its discretion the court struck out the plaintiffs' actions for want of prosecution (the abuse of process argument failed).
