The Court held that the presumption that a will in the deceased's custody which is not found after death was destroyed by the deceased applied and that the plaintiff failed to rebut that presumption; on the evidence, including the Deceased's meticulous habits and contemporaneous statements and conduct indicating an intention to alter testamentary provisions, the original Will was revoked by the testator and the appeal was dismissed.
