On the evidence the presumption of equal beneficial ownership was rebutted: the bankrupt made no financial contribution, moved out on marriage, the parties and their father shared the intention that the Property belong solely to the Respondent, and documentary/factual evidence supported that position; the court accepted the witnesses and concluded the Respondent is sole beneficial owner; accordingly the Trustees' application for sale was dismissed.
