The Court dismissed the appeal, holding that the claimant was entitled to summary judgment on the unconditional cheque. Allegations of forged documents, false inducement or breach of a separate agreement did not provide a defence to payment on the cheque; s.30 of the Bills of Exchange Ordinance did not assist the defendant and the circumstances alleged did not amount to fraud or total failure of consideration sufficient to avoid payment.
