The appeal was dismissed: the Court held that although s.13(1) limits the documentary proof a purchaser may require to Crown lease and 15-year root, it does not abolish the purchaser's right to raise proper requisitions on pre-intermediate title; on construction the power of attorney did not authorise assignments by way of gift, requisition (a) was properly raised and remained unanswered by the vendors, and s.13(4A) did not assist because only Memorials (not the executed assignment documents) had been produced.
