The appeal failed because the evidence overwhelmingly supported that PW3 was an unauthorized entrant and the trial judge properly rejected the applicant's claim that he believed she held lawful documents; the statutory defence under s.37D(2) was considered and not made out on the facts, and any omissions in cross-examination did not make the trial unfair or give rise to a material irregularity.
