The judge was entitled to accept the police officer's thermal imager identification and the linkage to the marine police interception, apply s.37K(1) in the absence of contrary evidence and, even ignoring the presumption, be satisfied the persons were unauthorised entrants; accordingly leave to appeal against conviction was refused and the five year sentences were not excessive so leave out of time against sentence was also refused.
