The 1st Defendant established a prima facie case for specific discovery; the 2nd Defendant's and its solicitors' replies and affirmations were incomplete and did not clearly state lack of possession, custody and power; the Personal Data (Privacy) Ordinance did not bar compliance with the initial discovery obligation; therefore the Master’s order requiring the 2nd Defendant to file an affidavit as to possession/custody/power of the documents is affirmed and the appeal dismissed.
