The Court of Appeal (majority) restored the interlocutory injunction because the Attorney General demonstrated a continuing interest in protecting confidential security service information in Hong Kong and an arguable case for a permanent injunction; prior foreign publication did not render interlocutory relief futile in Hong Kong, and the balance of convenience favoured restoration because refusal would cause irreversible prejudice (loss of effective protection and deterrence) while grant would only postpone defendants' publication rights until trial.
