The magistrate's imposition of one-year sentences suspended for three years was wrong in principle because he improperly departed from the customary tariff without special circumstances and took into account irrelevant factors (prison overcrowding/cost); the Court will only interfere with sentence where it is manifestly inadequate or excessive, and accordingly the Court substituted immediate sentences of 12 months' imprisonment to take effect from the dates of sentence.
