Absent clear statutory or constitutional provision to the contrary, a private person need not obtain the consent of the Secretary for Justice before applying for leave under O.52 rule 2 to bring criminal contempt proceedings; the court is the proper gatekeeper via the leave requirement and Article 63 and domestic rules do not impose an SJ veto.
