The Court held that although a 12-year sentence was within the proper range given the gravity and scale of importing 1.3 metric tonnes of opium and the applicant's supervisory role, mitigation including delay, periods at liberty following the quashed conviction and subsequent surrender warranted a reduction of 3 years; accordingly the sentence was substituted to 9 years imprisonment.
