Although the earlier court record was admissible and properly proved and the magistrate properly exercised discretion in admitting it, the admissions in the agreed statement of facts (made in plea to a different offence without caution and unsupported by other evidence) were insufficient for a reasonable tribunal properly directed to find a case to answer on the bribery charges; therefore there was no case to answer and no further action should be taken.
