On the facts the Court held the Immigration Tribunal breached its duty to act fairly to the minor appellants by failing to inquire about the mother's availability and by not alerting or assisting the unrepresented father to the crucial importance of the mother's evidence; that denial of a fair hearing warranted certiorari to quash the Tribunal's decision and a new hearing before a differently constituted Tribunal.
