Although there was some mischaracterisation of the Defendants' conduct as breaching the Mareva injunction, the Originating Summons and Statement nevertheless supplied sufficient particulars and the ex parte Leave Order was not shown to have been granted on a mistaken basis; however, because contempt proceedings are penal in nature and authorities require strict procedural compliance, leave to appeal is granted so the Court of Appeal can consider the procedural requirements and provide guidance; the amendment summons is adjourned pending that appeal.
