The Master exercised the statutory discretion under RHC Order 62 rule 16 to grant an 8 week extension because, although the respondent's delay was conscious and unjustified in part, the respondent's explanation (awaiting appeal/settlement), absence of prejudice to the applicant, and the availability of proportionate penalising measures under rule 22(5) meant refusal would impose a disproportionate penalty and be unjust; accordingly limited extension was appropriate.
