The Court of Appeal held that the Tribunal's procedural directions and case management fell within its discretionary powers and did not amount to breaches of Article 34(2)(a)(ii) or (iv); alternatively, the matters complained of were not sufficiently serious or prejudicial to deny due process or to warrant setting aside the award. Accordingly Saunders J's order setting aside the Award was reversed and the Award reinstated.
