Clause 92(8)(c)(i) must be read in its plain commercial meaning: 'entitlement to payment pursuant to any provision of the Contract' refers to contractual rights to payment (e.g. sums payable under contract provisions or formulae) and does not include claims for common law damages; therefore claims for damages at common law are not referable to adjudication under clause 92(8)(c)(i), given the purpose and structure of adjudication as a quick, final and binding remedy unsuitable for complex damages claims.
