The appeals are dismissed: the judge held the PM did not err in awarding costs on 14 January 2013 because the prosecution was unprepared and had not provided summaries of facts or authorities; the PM erred in procedure on 18 February 2013 by failing to apply Lam Chiu Fong and by treating parity with earlier orders as decisive, but on the merits the respondents had not brought suspicion on themselves so there was no positive reason to deny costs; accordingly the magistrate's costs orders are upheld and the prosecution's appeals are dismissed.
