    HKSAR v. CHAN WING HUNG

    Citation
    HKSAR v. CHAN WING HUNG
    Court
    Court of Appeal
    Case number
    CACC430/1996

The court held that for s.119 purposes 'unlawful' may be read as illicit/outside marriage (or treated as surplusage), that the applicant's admissions coupled with other evidence (agreements, ATM slips, tapes found on arrest, and knife) provided cogent corroboration of the use of threats to procure intercourse (even though an admission of intercourse cannot by itself corroborate non-consent), and that any misdirection by the trial judge was harmless under the proviso so the convictions stand.
