The court held that the magistrate's starting point of 12 months (reduced to 8 months for plea) was excessive given the essentially economic nature of the offence; having regard to time already in custody the appropriate outcome was to reduce each sentence to 2 months (from 8) and leave the existing suspended sentence in place, resulting in immediate release owing to time served.
